Need to divorce but cant afford to. What can we do?
My husband and I are looking to get a divorce. We live in sioux Falls, SD, but we can’t afford to pay a lawyer to do it. Is there some kind of help or someone that might be able to help us file for little to nothing? (SD)
South Dakota allows grounds for divorce as no-fault with “irreconcilable differences which have caused the irretrievable breakdown of the marriage.” You don’t have to go into detail about why you want to get a divorce. If both parties agree, the court can grant the divorce based on the documents alone and a personal appearance is not usually required. The least expensive way to complete the divorce may be to obtain the documents you’ll need from an online legal forms service and file them yourself. You could also check with your local Clerk of the Court for the required forms. If you do complete your divorce by yourself (pro se divorce), South Dakota requires that the parties must complete a checklist that verifies all the necessary forms have been completed. The Pro Se Checklist should be included in the stack of forms whether you get them from an online service or the court itself.
