Severance/early retirement pkg.

Question:

Our Divorce Decree of 2/09 (after 34 yrs. of marriage) states I (ex-wife) am entitled to 29% spousal support of earned income of ex-husband as long as he has earned income. I also was awarded a marital portion of husband GE pension. The QDRO for pension has a parag. granting me a portion of early retirement pkg. Ex-husband signed early retirement papers 3/19/09 and was granted a severance pkg., $60K of which was based on his 30+ yrs of service with GE. Ex-husband is claiming I am not entitled to any of early retirement pkg. Are there any Ohio cases that would support my position in Ohio courts to receive a portion calculated either as marital portion of pension or as spousal support.

State:
Ohio

Answer:

While there are times to handle things yourself, there are also times that it is best to seek some assistance. In this case, we do not practice law in Ohio and could not cite any prior cases to support your position. You should probably consult a divorce attorney that is familiar with the laws in your locale. If you can afford it, it would be in your best interest to make sure your bases are covered and you are full aware of the laws and your rights in this instance. – The Divorce.com Team
