750 ILCS 5/504 governs. FORMULA for cases where combined gross under 500k annually no multiple families. Amount AND duration guidelines.

Formula

Amount: 33.33 percent payor net minus 25 percent recipient net. Total cannot exceed 40 percent combined net.

Example: A nets 6500 B nets 2500. Calculation: 6500 times 0.3333 minus 2500 times 0.25 equals 2167 minus 625 equals 1542. Check: (2500 plus 1542) divided by 9000 equals 44.9 percent exceeds 40 percent cap so reduce to 40 percent equals 1100 monthly.

Duration Guidelines

Under 5 years: 20 percent marriage. 5-10 years: 40 percent. 10-15 years: 60 percent. 15-20 years: 80 percent. 20 plus years: court determines often permanent.

Tax

Post-2018: NOT deductible NOT taxable. Illinois follows federal. State flat 4.95 percent.
